Abstract

Recent legal developments suggest that stability in the securitization market—particularly with regard to subprime mortgages and asset-backed CDOs—continues to be tested by intense litigation and enforcement activity. Structured finance litigation has caused litigants and the courts to apply traditional legal concepts to complex and sometimes unfamiliar financial transactions, resulting in unique circumstances that mandate particular diligence in litigation management.
